At INCUBE, we place great importance on prior art search and analysis.

To obtain patents, utility models, designs or trademarks, you need to assess the likelihood of registration carefully in advance and check the risk of infringing others’ rights. In particular, turning an idea into a concrete technology and then into a registered patent requires essential steps: understanding the technology, searching the prior art, assessing patentability, and identifying and resolving weaknesses.

For this reason, we search and analyze prior patents to assess patentability in advance, raise the chances of registration through legal and technical support, and evaluate whether practicing the invention could infringe others’ patents. Through thorough search and analysis, we identify and prevent issues that could arise later.

We also analyze competitors’ patents at the early stage of R&D to show where the technology stands from a patent perspective, including filing trends and its stage of development. We identify blocking patents, assess the possibility of designing around them, and reflect the results in the design, helping to set the direction of R&D. Where needed, we propose and carry out the most reasonable course of action, such as invalidity searches, finding counter-patents or negotiating licenses, as a reliable partner for our clients.
